Privy Council Judgment - Dawn Satterswaite and 2 others (Respondents) v Bobbette Smalling (Appellant) (Jamaica)
Andrew Mitchell KC together with Caroline Hay KC and Nigel Parke from Jamaica successfully represented the Major Organised Crime Agency of Jamaica (MOCA) before the Privy Council who appealed a decision of the Jamaican Court of Appeal following their placing a limit on the reach of search and seizure warrants under the Jamaican Proceeds of Crime Act. Reversing the Court of Appeal, the Privy Council held that material relevant to a criminal investigation that was in existence before the commencement date of the Act was caught by the legislation and properly the subject of a search and seizure warrant.
