Financial Crime.
We regularly act on behalf of corporate clients and individuals, and government entities in matters of corruption including disgorgement, injunctive relief and damages, as well as criminal investigations and/or trials for corruption, bribery or failing to prevent.
Members advise and act for companies and individuals on UK Bribery Act Liabilities and FCPA exposure, as well as seeking civil recovery settlements in lieu of criminal proceedings. In addition, we conduct review of search, seizure, production, urgent injunctions as well as advising financial institutions and others on making protected and authorised disclosures to regulatory bodies.
The team has represented various individuals, directors and corporates in relation to applications for account freezing & forfeiture orders, as well as those charged with corruption concerning substantial contracts, across multiple jurisdictions and industries within financial, property and real estate, construction and engineering, energy and natural resources, manufacturing and supply, transport and healthcare sectors.
As part of our offering, members often conduct and review stress testing of internal controls, corporate policy and adequate measures. We also advise and represent firms on their approaches to UK regulators including anonymised scoping, and corporates in relation to regulatory action brought by the FCA for any breach of FSMA and in relation to criminal liability.
The team often advise on internal investigations, and we have also been involved in some of the largest HMRC, FCA and SFO investigations and trials to date. We acted in the first LIBOR and EURIBOR trials, as well as the following investigations GPT Special Project Management Limited, Glencore, Unaoil, Petrofac, ENRC, Chemring Group Plc, Tesco, Glaxo, JJB, Alstom, Capita Oak Pension, Ethical Forestry Limited, London Capital & Finance, Rolls-Royce, Quindell, Tesco, Barclays, Operation Naples, Ashland, Chandler, Tidworth, Gillingham, Kempston, Tabernula, Alfreton, and Pontefract.

Many of our cases have an international element including Turks and Caicos Islands (Missick and Others) where we were instructed on an investigation, prosecution and defence of individuals on charges of bribery and corruption following a Commission of Inquiry. We also acted in the most ground-breaking case of, Innospec in which the criminal matters to corruption in Indonesia were dealt with in the UK and US Courts, simultaneously.

Investigations.
Our investigations experience often relates to criminal (and civil) commercial wrongdoing, financial misconduct or wrongdoing, non-financial misconduct, workplace incidents, regulatory breach and business protection.
We are regularly instructed to advise at the early stages of a potential investigation and conduct the investigation as independent counsel or as part of a team. That process will often include assessing the information and situation, provide a report on findings and make necessary recommendations to either resolve which may include reporting to key stakeholders or to (and in cooperation with) the relevant regulatory authority, including if matters proceed to a trial (civil or criminal).
These are often high stakes and of key importance to the business and/or individual that is faced with a potential investigation.

Tax Disputes.
Our members have been involved in the most complex Tax disputes, particularly those with an emphasis on POCA 2002, and where there are parallel civil and criminal proceedings.
We often advise on strategy across all proceedings ( and anticipated proceedings), including on whether to seek a stay, communication and negotiations with the other side, interview tactics and correspondence.

Exercise of HMRC functions and powers:
We can assist in challenging the exercise of those functions and powers, in particular: searches pursuant to warrants, account freezing orders, schedule 36 FA 2008 information notices, the imposition of penalties, and accelerated payment notices.
Failure to prevent the facilitation of tax evasion.
We assist in developing reasonable prevention procedures as a defence to the corporate offence under CFA 2017 and can advise on self-reporting and/or responding to any investigation.
Criminal investigations.
Matters in which accountants wish to continue to advise the existing corporate or individual client. We advise on communication and negotiation with investigators, interview tactics and correspondence, and we address any issues relating to risk of restraint and account freezing.
Tax irregularities.
When irregularities are raised by an existing corporate or individual client or whistleblower; or discovered by ordinary accounting advice, we assist in the strategic response to avoid a criminal outcome, mitigate tax penalties, and can assist accountants in the maintenance of the relationship between the client and HMRC
HMRC Inquiries
Matters which might lead to an appeal to the First-tier Tribunal/Upper Tribunal. We provide early assistance to address potential serious risks, and can function as a buffer between accountants and HMRC

Yip v Commissioners for His Majesty’s Revenue and Customs [2024] UKFTT 434 (TC): Successfully acted for the taxpayer in an appeal concerning the tax treatment of a quarter of a million pounds received by the appellant over 10 years ago. HMRC v B: Strategic and day-to-day involvement in a major tax appeal for a Fortune 500 company before the First-tier Tribunal and then Upper Tribunal, spanning 3 years.
HMRC v X: Advised the Respondent to account forfeiture proceedings brought by Kent Police, and parallel tax tribunal proceedings against HMRC.
Malde & Others v HMRC: Successfully represented the Appellants in 3 month appeal against personal liability notices and penalties relating to alleged huge diversion and VAT fraud. The case involved multi-jurisdictions and companies and trusts from numerous countries.
Borough Green Sandpits: Challenge on statutory and public law principles to multi-million pounds Landfill Tax imposition.
HMRC v Windsor & Others: Lead defendant in a 6 month trial relating to duty and VAT fraud, including issues of abuse of process, disclosure and intrusive surveillance.
Mcarthur and others: Successful appeal against disallowal of claims in relation to charitable tax relief.
Nuttall & Others v HMRC: Representing lead appellant in Tax Tribunal dispute re: company valuations for gift aid.
R v Davies (Southwark Crown Court) - Junior defence counsel, £2.5 million tax evasion.
Seabrook Warehouses v HMRC: Successful challenge to withdrawal of approvals for operations relating to Bonded warehouses, including litigation in the Administrative Court, Court of Appeal and the First Tier Tax Tribunal.
Field Opportunities v HMRC: VAT input case involving Kittel principles. Alistair was described, in the FTT’s decision, as having “acute forensic skills.”
Secured a settlement with HMRC regarding the valuation of a property in a tax dispute for a high-net-worth client based in Kuwait. Praised by the client for being “pro-active, prompt, honest, pragmatic”.
Advised a company on challenging HMRC’s decision to cancel its registration under the UK anti-money laundering regime, in a matter involving allegations of CJRS (furlough) fraud and PAYE irregularities.
As part of a team, assisted with corporate internal tax investigations and related extensive disclosure exercises. Heavily involved in drafting related advice on protecting legal professional privilege in such circumstances.
Involved in multiple tax judicial reviews, including in case strategy and procedure prior to proceedings before the Administrative Court, and an application for permission to appeal to the Supreme Court.

HMRC v PS, THL (a Gibraltar Company) - Intervening third party corporate applicant (s.301 PoCA). Defeated allegation of Directors' corruption.
EAH Ltd. v HMRC - First-tier tax tribunal appeal of a decision to deny VAT recovery involving UK supplied helicopters held under US owner-operated trusts
Assisted with urgent advice on a civil tax fraud investigation (COP 8), including as to the risk of civil evasion penalties.
Practical experience providing technical and strategic advice on:
disclosing historic tax irregularities;
challenging information notices and accelerated payment notices; and
appealing discovery assessments.
Europlus Ltd v HMRC [2011] UKFTT 635 (TC) - First-tier tax tribunal success against Revenue and Customs Commissioners for applying new requirements upon an importer's drawback claims in which it was found that HMRC had breached European and Human Rights law and the principle of elementary fairness through a retrospective change of policy.
Dispute Resolution.
We act in Regulatory and Disciplinary matters on behalf of financial institutions and in criminal regulatory and enforcement proceedings for individual and corporate defendants. Members are also often appointed in disciplinary Tribunals as panel members, chair or on behalf of respondent parties in respective proceedings.
More widely, members are appointed by sports bodies including Professional Cricketers’ Association and the League Managers' Association. Chambers have also represented PLC’s and other corporates in defending allegations of mis-selling practices.
Our Regulatory matters often have an international element, having acted in a Prosecution of a Hong Kong CIOT Fellow, upon allegations of multi-million HK$/AUD$/€ misappropriation from a series of clients in Hong Kong, Singapore and Australia.
Members also work with the Bar Council in designing and delivering training for the Bar in respect of money laundering issues relating to direct access instructions.
